1. Introduction & Acceptance

These Terms form a binding contract between you ("User", "you") and KL Digital LLC ("Company", "we", "us"). Creating an account, browsing, or otherwise using the Platform constitutes your full and unconditional acceptance of these Terms and of our Privacy Policy, Cookie Policy, DMCA Policy, 2257 Compliance Statement, Refund Policy, Takedown Policy and Age Verification Policy, each incorporated herein by reference.

The Platform is operated by KL Digital LLC, a Limited Liability Company organized under the laws of the State of Wyoming, United States.

3. Eligibility

You must be at least eighteen (18) years old to access or use the Platform, or the age of majority in your jurisdiction, whichever is greater. You must have the legal capacity to enter into a binding contract.

The Platform is not directed to and must not be used by minors. Any fraudulent registration by a minor will result in immediate account termination and may be reported to competent authorities.

An age gate is deployed on the Platform. See our Age Verification Policy.

4. Nature of the Service

The Platform is an online adult-oriented community where consenting adults create a profile, browse other members and exchange messages. Nothing sexually explicit is published on the Platform: profiles, albums and every area visible to the community at large are limited to suggestive, sensual or fetish-oriented imagery. Private messages are correspondence between two consenting adults, who remain free to share with one another what they wish, within the limits of section 7 and of applicable law. What members choose to do once they have met takes place outside the Platform and is their own responsibility.

The Platform does not provide escort, prostitution or in-person matchmaking services. Any commercial solicitation unrelated to the service is strictly prohibited.

Illustrative profiles. During the launch phase, some profiles displayed on the Platform are illustrative examples created by KL Digital LLC to demonstrate the community structure and seed conversations. These profiles are flagged as is_demo in the database and are removed from member listings as the real-user base grows. Real members are clearly identifiable in their profile settings (their own profile shows the editable fields) and through verified interactions; illustrative profiles do not initiate paid transactions.

5. Registration and User Account

Registration requires a valid email address and a secure password. You are solely responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account.

You must provide accurate information and keep it up to date. One individual may hold only one account, except as expressly authorized.

You may delete your account at any time from your profile settings. Deletion is permanent, subject to limited retention for legal and billing purposes.

6. Subscriptions and Payments

Paid subscriptions are billed and processed by CCBill, our authorized payment processor, which acts as Merchant of Record for all subscription transactions. No bank card data is stored on our servers.

Subscriptions renew automatically until cancelled. You may cancel at any time via the processor portal or by contacting us (contact@kinklabyrinth.com) or by contacting contact@kinklabyrinth.com at least 24 hours before renewal.

7. Conduct and User Content

You retain ownership of the content you upload ("User Content") and grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, display and distribute such content for the purpose of operating and promoting the Platform.

You represent and warrant that (i) you are at least 18, (ii) every person depicted in your User Content is at least 18 and has consented to the depiction and its publication, (iii) your User Content does not infringe any third-party right and does not violate any law.

Public areas and private correspondence are governed differently. Anything visible to the community at large — your profile, your album, your username and your biography — must remain free of sexually explicit visual material: suggestive, sensual and fetish-oriented imagery is welcome, depictions of sexual acts or genital nudity are not. Private messages are correspondence: two consenting adults may share with each other what they wish, and we do not curate it. The prohibitions below apply everywhere without exception, private messages included, and we act on reports under section 8.

The following are strictly prohibited: content depicting minors (including any CSAM, which will be reported to NCMEC and law enforcement), non-consensual intimate imagery, impersonation, doxxing, harassment, incitement to violence, hate speech, bestiality, necrophilia, incest involving minors, trafficking, or any illegal content under U.S. federal law or applicable local law.

8. Moderation and Suspension

We may, at our sole discretion, review, remove or disable access to any User Content, and suspend or terminate any account that violates these Terms or applicable law, with or without notice.

We operate a repeat-infringer policy: accounts that repeatedly violate our rules will be permanently terminated.

9. Intellectual Property

All Platform elements (trademarks, logos, source code, design, texts, databases) other than User Content are the exclusive property of KL Digital LLC or its licensors and are protected by U.S. and international intellectual property laws. Any unauthorized reproduction is prohibited.

10. Personal Data

Our processing of personal data is described in our Privacy Policy. Please read it carefully. It covers GDPR (EU/EEA), UK GDPR, CCPA/CPRA (California) and PIPEDA (Canada) rights, international transfers, and contact details for our DPO.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. KL DIGITAL LLC DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, KL DIGITAL LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE OR DATA. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death, personal injury, fraud, gross negligence or, for EU/UK consumers, statutory rights.

12. Indemnification

You agree to defend, indemnify and hold harmless KL Digital LLC, its officers, employees and agents from and against any claim, liability, damage, loss and expense (including reasonable attorneys' fees) arising out of or in any way connected with (i) your User Content, (ii) your breach of these Terms, (iii) your violation of any law or third-party right.

13. Termination

You may terminate your account at any time. We may suspend or terminate your access for breach of these Terms, legal requirement, or legitimate business reason. Sections that by their nature should survive termination (IP, liability, indemnity, dispute resolution) will survive.

14. Governing Law and Jurisdiction

Primary: these Terms are governed by the laws of the State of Wyoming, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to the clauses below, the exclusive forum for disputes is the state or federal courts located in Sheridan County, Wyoming.

EU / EEA consumers: if you reside in the European Union or the EEA, you benefit from the mandatory consumer protections of your country of residence, including those under Directive 2011/83/EU (consumer rights) and Directive 2019/770/EU (digital content and services). Nothing in these Terms deprives you of those mandatory protections, and you may bring proceedings before the courts of your place of residence.

EU ODR platform: the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is contact@kinklabyrinth.com.

EU right of withdrawal: EU/EEA consumers have a 14-day right of withdrawal from distance contracts. However, for digital content and services supplied without a tangible medium, this right is lost once performance begins with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal (Directives 2011/83/EU and 2019/770/EU). Before a subscription is completed you are asked to tick a separate box, not ticked in advance, by which you expressly request that your access begin immediately and acknowledge that you thereby lose this right. We keep a record of the exact wording you were shown, in your language, with its date.

UK consumers: you retain equivalent statutory rights under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

15. Changes to These Terms

We may update these Terms at any time. Material changes will be notified via email or in-app notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
